AN ACT to amend and reenact sections 15.1-23-01, 15.1-23-03, 15.1-23-06, 15.1-23-08, and 15.1-23-17 of the North Dakota Century Code, relating to home education; and to provide an expiration date.

This bill related to the supervision of home education, the qualifications and monitoring of parents supervising home education, and the physical location of instruction.  This bill was a good first step in removing some unneeded regulations hindering the efforts of home schoolers across the state.

SB 2199:  AN ACT to create a property tax relief sustainability fund; to create and enact two new subdivisions to subsection 3 of section 57-15-01.1 and chapter 57-64 of the North Dakota Century Code, relating to allocation of state funds to school districts for mill levy reduction grants; to amend and reenact sections 57-15-14, 57-15-31, and 57-38-30 and subsection 1 of section 57-38-30.3 of the North Dakota Century Code, relating to property tax levies of school districts, corporate income tax rates, and income tax rates for individuals, estates, and trusts; to repeal section 15.1-27-20.1 of the North Dakota Century Code, relating to the effect of the general fund levy of school districts on state aid allocations; to provide an appropriation; to provide for transfers; and to provide an effective date.

HB 1324, in its original form, provided for an income tax reduction.  That reduction was rolled into SB 2199 and passed.  SB 2199 provides for $100M in ND income tax  reduction, $90M personal and $10M corporate.  Additionally, SB 2199 has provided for $295M in property tax relief, by way of reducing school district mill levies.  What passed was the elimination of the long form in filing North Dakota state income tax.  NDFA supports all sustainable efforts to allow more of our hard earned money to remain with the family.

AN ACT to amend and reenact sections 14-02.1-04 and 14-02.1-07 of the North Dakota Century Code, relating to limitations on the performance of abortion and abortion reporting requirements. 

An abortion facility may not perform an abortion on a woman without first offering the woman an opportunity to receive and view an active ultrasound of her baby. This language must be shared with the woman seeking an abortion, at least 24 hours previous to the abortion being performed.

The bill was to expand the role of the commission far beyond advocating for women, which the present commission does very adequately.  The expanded role was to include health issues, including reproductive health matters.

This bill relates to the posting of a notice in the abortion facility stating "no one can force you to have an abortion.  It is against the law for a spouse, a boyfriend, a parent, a friend, a medical provider, or any other person to in any way force you to have an abortion."

This bill would have prohibited discrimination based on sexual orientation, including transgender, meaning identification with a gender different than that assigned at birth.  It would have provided for special status and protection based on chosen and changeable behaviors and conduct.

This bill provides funding for the alternatives to abortion services program, and specifically enhances the effort to raise the level of awareness of the program to those who may be considering an abortion.

SB 2394 - PRENATAL CARE FOR MINORS - NDFA Opposed- Neutral/ Bill Passed

AN ACT to create and enact a new section to chapter 14-10 of the North Dakota Century Code, relating to consent for prenatal care and other pregnancy care services provided to minors; and to provide for a legislative council study.

This bill relates to a pregnant minor accessing prenatal care.  As introduced, it allowed a pregnant minor to consent to and contract for prenatal care (self emancipation).  NDFA opposed this version.  As amended, the physician or health care provider may provide limited prenatal care, with certain stipulations.  While the bill limited the prenatal care, it is an erosion of parental involvement and their rights.  Even with these improvements to the bill, we could not support the erosion of parental rights.  We do applaud the efforts of the House Human Services Committee members for their efforts.  An accompanying study will allow us to follow this issue, and determine what action to take in the future.
